The Texas Deceptive Trade Practices Act was enacted to:
- Provide consumers with a cause of action for deceptive trade practices
- Encourage consumers to litigate claims that would not otherwise be economically feasible
- Deter false, misleading, and deceptive business practices, unconscionable actions, and breaches of warranty in trade or commerce
Violations of the DTPA can result in significant penalties, including awards for attorneys’ fees and for mental anguish. In cases where a party proves a defendant knowingly or intentionally violated certain provisions of the DTPA, an aggrieved consumer can recover up to three times the amount of economic or mental anguish damages as well.
